Kirk Palmer & Thigpen’s Financial Restructurings and Foreclosures practice area was formed to meet the rising need for skilled counsel in this complex area of practice. Our lawyers’ experience and expertise in our Corporate and Real Estate Finance practice group, along with our other practice areas, enable us to provide our clients with the breadth and depth required in commercial loan restructurings, pre-litigation and pre-bankruptcy workouts and foreclosures.

Our lawyers have represented and assisted national, regional and community banks, as well as other financial money centers, in connection with the restructuring of bad loans and the foreclosure of commercial real estate projects. Our representation of such lenders prior to the bringing of a foreclosure action includes analyzing, structuring and negotiating forbearance agreements and other related loan modification agreements. Once a lender has determined to foreclose on commercial real estate securing the debtor’s obligations to such lender, we serve as substitute trustee under the deed of trust securing such obligations. At that point, our lawyers handle all aspects of the foreclosure proceedings.

In order to provide our clients with the full service needed to handle all aspects of creditors’ rights proceedings, we partner with a handful of other boutique law firms and, in some instances, large law firms that specialize in creditors’ rights, bankruptcy, collection and litigation matters. We provide reciprocal services to these law firms by acting as the impartial trustee in commercial real estate foreclosures, where such law firms continue to represent the lender throughout the foreclosure proceedings.
